The Department of Women Development and Child Welfare of Government of Telangana has recently launched a Web-Portal called ‘T-SHe Box’ to provide a single window access to women employees to register their complaint against Sexual Harassment at Workplace.
Requirements as per Act:
The POSH (Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, requires establishments with more than or equal to 10 employees to constitute an Internal Complaints Committee (ICC) for resolving sexual harassment complaints at workplace.
Constitution of Internal Complaints Committee:
Every organization has to constitute an Internal Complaints Committee (ICC) having the following members:
- Presiding Officer – Women working at senior level in the organisation
- 2 Members (at least) – Amongst employees preferably committed to women issues or had experience in social work or have legal knowledge
- 1 Member – from NGOs or associations committed to the cause of women or a person familiar with the issues relating to sexual harassment
Provided that at least one-half of the total Members so nominated shall be women.
If the organisation has workplaces located at different places or division or sub-division level, then ICC will be constituted at every workplace.
Registration:
As per the public notice issued by Telangana Govt, each employer is required to register and furnish details of their Internal Complaints Committee(ICC) on the portal
Timelines & Penalty:
The due date for registration is 15th July 2019. Failure to comply with this requirement may attract a penalty of Rs. 50,000.
Companies can advise their HR Managers to check the applicability of the Act to your organization and to undertake the registration formalities. This requirement falls under the Establishment & Employment related Laws and is mandated by the Telangana Government and not Companies Act.
